OVERVIEW

On August 8, 2005, President Bush signed into law the most comprehensive energy reform legislation since the Energy Policy Act of 1992. This broad energy reform legislation will impact almost every facet of the energy business. The Energy Policy Act of 2005 (EP Act 2005) revises the Federal Power Act and Natural Gas Act in significant ways, repeals the Public Utility Holding Company Act of 1935, substantially changes the qualifying facility provisions of the Public Utility Regulatory Policies Act of 1978, and enacts tax incentives for the development of renewable and cleaner-fuel electric generating resources and for other electric and gas related purposes. EP Act 2005 will also have significant implications for the nuclear industry as well.
