Sierra Club to sue owners of coal-fired plant over air emissions

The Sierra Club Thursday said it will sue the utility owners of the 2,340-MW
Stuart coal-fired power plant in southern Ohio for alleged violations of the
Clean Air Act. The group sent official notices of the pending suit to Dayton
Power & Light, American Electric Power and Cinergy. Since 1999, when the US
Environmental Protection Agency issued a notice of violation against the
plant, Stuart's emissions have increased dramatically, the Sierra Club
charged. According to the Sierra Club, Stuart would be required to reduce its
sulfur dioxide emissions by more than 100,000 tons annually, as well as make
significant reduction in its nitrogen oxides and soot, to comply with Clean
Air Act provisions. Spokesmen for both AEP and Cinergy declined comment on the
Sierra Club's litigation plans, referring all questions to DP&L, which
operates the plant. A DP&L official said Stuart is the third-largest power
plant in Ohio and would emit more pollutants. But the plant also is among the
"most efficient" generating facilities in the state, she added.
